Giving Birth While Tied to the Bed...

The title of this NY Times article says it all: Prisons Often Shackle Pregnant Inmates in Labor. It's hard to imagine a woman who is the middle of giving birth honestly being a "flight risk." Even more shocking, only two states outlaw this practice--and only recently! This practice is a civil rights case (ยง 1983) just waiting to be litigated...and rightly so. Can we say 'cruel and unusual punishment?' How about 'deprivation of substantive due process?' All I can say is that if more women were legislators, there is no way that this practice would still be permissible. The guy from Amnesty got it right when he said the practice is "almost as stupid as shackling someone in a coma."
